Step 1: Negotiation. The parties shall first attempt to resolve the dispute through good faith negotiation for a period of thirty (30) calendar days from written notice of the dispute.
Step 2: Mediation. If negotiation does not resolve the dispute, either party may submit the matter to mediation administered by the Centro Internacional de Conciliación y Arbitraje (CICA) de Costa Rica, in accordance with its mediation rules.
Step 3: Arbitration. If mediation does not resolve the dispute within sixty (60) calendar days, the dispute shall be submitted to binding arbitration administered by CICA, in accordance with its arbitration rules then in effect. The seat of arbitration shall be San José, Costa Rica. The language of the arbitration shall be Spanish. The arbitral award shall be final and binding on both parties.
Injunctive relief. Notwithstanding the above, either party may seek injunctive or other equitable relief from the competent courts of San José, Costa Rica, to protect its intellectual property rights or to prevent imminent harm.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent court or arbitral tribunal, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and The Digital Bite regarding your use of the Website. These Terms do not create any agency, partnership, joint venture, or employment relationship between you and The Digital Bite.
